Your Tenancy

Your Tenancy Agreement
Your Tenancy Agreement is a legally binding document and you should read it carefully before you sign it. If you are uncertain about any of the points you should ask your Housing Officer for an explanation or take independent legal advice.
When you sign your agreement, you will be offered either a Starter Tenancy (link) or an Assured Tenancy.

Starter Tenancy
You will be given a Starter Tenancy if this is your first tenancy with a Registered Provider or if there has been a break in time since your last tenancy. A Starter Tenancy is an Assured Shorthold Tenancy agreement and is a probationary agreement which lasts for twelve months. It is similar to an Assured Tenancy, however there are certain rights you do not have. See ‘starter tenancies’ for more information.

Assured Tenancy
An Assured Tenancy gives additional rights and allows you to stay in your home providing that you do not breach any of your conditions of tenancy. If you do breach your tenancy conditions, the Society can take action against you, which could mean that you will lose your home. The Society would have to satisfy the courts that eviction is the only solution, and before this happened you would have had ample opportunity and assistance to remedy the situation.

Secure Tenancy
A few of our residents will have Secure Tenancies. These are tenancies which were granted before 15th January 1989, and are protected by the Housing Act 1985. The main differences are in the action that we would take for breach of tenancy and in the calculation of service charges.
